PLEASE READ THESE TERMS AND CONDITIONS ("TERMS") CAREFULLY BEFORE USING THE SERVICES OFFERED BY 6 SIGMA EXPERTS ("WE," "US," "OUR"). THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF OUR WEBSITE AND PLATFORM (COLLECTIVELY, THE "SERVICE").

By accessing or using the Service in any manner, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you may not access the Service.

1. Description of Service

6 Sigma Experts provides a technology platform that connects users ("Users," "you") with experienced traders ("Master Traders"). Our Service facilitates the automatic replication of trades from a Master Trader's account to a User's linked brokerage account via an Application Programming Interface (API).

Disclaimer: 6 Sigma Experts is a technology and information platform only. We are not a registered investment advisor, broker-dealer, or financial institution. We do not provide financial advice, trading signals, or portfolio management services. The Service is for educational and informational purposes only.

2. Eligibility

To use our Service, you must:

  • Be at least 18 years of age.

  • Be legally competent to enter into a binding contract.

  • Provide accurate, complete, and current registration information.

  • Not be barred from using financial services under the laws of India or any other applicable jurisdiction.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account login credentials and your brokerage API keys. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. You are solely responsible for all activities that occur under your account.

4. Fees and Payments

  • API Connection and Setup Fee: A one-time, non-refundable fee is charged for account setup and personalized support.

  • Master Trader Change Fee: A fee of ₹2,499 is applicable each time you request to change your selected Master Trader.

  • API Charges: Your use of the Service may incur charges related to API calls, which are subject to revision.

All payments are subject to our Refund Policy, which is incorporated by reference into these Terms.

5. Master Traders

  • Vetting: We perform a verification process on Master Traders based on their track record. However, this is not an endorsement or recommendation.

  • No Guarantee: Past performance of any Master Trader is not indicative of future results. We do not guarantee the performance of any Master Trader.

  • Selection: You may choose a known Master Trader or opt for the "6Sigma Handpicked Traders," who are anonymous and dynamically selected by our team based on performance metrics. The selection and rotation of Handpicked Traders are at the sole discretion of 6 Sigma Experts.

6. Acknowledgment of Risk and Disclaimers

This is a critical section. By using the Service, you explicitly acknowledge and agree to the following:

  • Inherent Risk: Trading in financial markets, especially derivatives and options, involves a very high degree of risk. You may sustain a total loss of your capital and may even be liable for losses exceeding your initial investment.

  • No Financial Advice: All information and trade data provided through the Service is for informational purposes only and does not constitute financial, investment, legal, or tax advice. You are solely responsible for your investment decisions.

  • No Guarantee of Profit: There is no guarantee that the use of our Service or the trades copied from any Master Trader will result in profits.

  • Slippage and Execution: You understand that slippage (the difference between the expected price of a trade and the price at which the trade is actually executed) is a normal market phenomenon. We and our Master Traders are not responsible for any losses incurred due to slippage or poor trade execution from your broker.

  • Stop Losses: While Master Traders execute trades with stop losses, these are not guaranteed to execute at the specified price and will not protect you from losses in all market conditions (e.g., market gaps).

  • Sole Responsibility: You are solely responsible for the capital you deploy, the risk you take, and all outcomes in your trading account.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 6 SIGMA EXPERTS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF THE SERVICE; (II) THE PERFORMANCE OR NON-PERFORMANCE OF ANY MASTER TRADER; (III) ANY BUGS, VIRUSES, OR ERRORS IN THE PLATFORM; (IV) ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT.

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT OF FEES YOU HAVE PAID TO US IN THE THREE (3) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY.

8. Indemnification

You agree to indemnify and hold harmless 6 Sigma Experts and its employees, directors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will cease immediately.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. You agree that any legal action or proceeding arising out of these Terms will be brought exclusively in the competent courts located in Bengaluru, Karnataka, India.

11. Amendments to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
